Definitions
Section 1 The terms and expressions used in this Ordinance have the same meaning as in the Antarctic Act (2006:924).

Permits

Section 2 The Swedish Polar Research Secretariat will consider matters regarding permits for stays or operations in the Antarctic under the Antarctic Act (2006:924) and matters concerning exemptions from the permit requirement.

Section 3 Before the Swedish Polar Research Secretariat makes a decision on a permit or exemption, the Secretariat will give the Swedish Environmental Protection Agency and the Swedish Agency for Marine and Water Management an opportunity to express its views. Ordinance (2011:635)

Section 4 As regards a stay or operation for which the Swedish Polar Research Secretariat is the principal, a permit or exemption may only be granted if supported by the Swedish Environmental Protection Agency and the Swedish Agency for Marine and Water Management. Ordinance (2011:635)

Compensation under Section 20 of the Antarctic Act (2006:924)

Section 5 Compensation under Section 20 of the Antarctic Act (2006:924) shall be paid to the Swedish Polar Research Secretariat, which will pass this compensation on to a fund administered by the Antarctic Treaty Secretariat.

Compensation shall be calculated by estimating the cost of reasonable measures needed to, according to what is possible in the individual case, quickly and effectively avert, minimise or limit the effects of the environmentally hazardous accident. This estimate should always include what it would have cost to determine the scope of the environmentally hazardous accident.

Contingency plans

Section 6 A contingency plan under the second paragraph of Section 7 of the Antarctic Act (2006:924) shall, when relevant considering the environmentally hazardous accidents that may occur as a consequence of the operation, state

1. procedures for reporting accidents,
2. the resources available and how these can be mobilised,
3. routines to determine the scope of accidents and other reasonable measures that can be taken to quickly and effectively avert, minimise or limit the effects of the accidents,
4. routines for documentation, and
5. training measures that the contingency plan calls for.

Supervision, etc.

Section 7 The Swedish Polar Research Secretariat shall exercise supervision of compliance with the Antarctic Act (2006:924), this Ordinance and conditions issued pursuant to the Act.

If the Secretariat becomes aware that someone who has breached such provisions or conditions, the Secretariat shall take measures to effect rectification and, if necessary, make a report for the prosecution.

Section 8 The Swedish Polar Research Secretariat shall receive information about environmentally hazardous accidents that have occurred in the Antarctic and when necessary shall pass this information on to the relevant parties and to others affected.

Section 9 The Swedish Environmental Protection Agency and the Swedish Agency for Marine and Water Management shall monitor that decisions on permits under the Antarctic Act (2006:924) are consistent with the purpose of this Act. Ordinance (2011:635)
